TERMS AND CONDITIONS

Information on how to enter forms part of these conditions. Entry into this promotion constitutes acceptance of these terms and conditions.

  1. Entry is only open to Australian residents, aged 18 and above.
  2. Employees (and their immediate families) of the Promoter and agencies associated with this promotion are ineligible to enter. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin.
  3. The “Promotional Periods” are as follows: 
  1. To be eligible to enter the competitions during the Promotional Period, each entrant must:
    • Enter relevant information through the advertised entry channel; the entrant will then be entered into the Draw (as defined in paragraph 8).
  2. Only one (1) entry is permitted per person for each survey.
  3. An approved computerised system will draw one (1) prize winner (“the Winner”) on the following dates; 
  4. (“the Draw”). The Draw will be conducted by STC at Wharf 4/5, 15 Hickson Rd, Walsh Bay NSW 2000.   
  5. The Prize (“the Prize”)  includes:
  6. The Promoter reserves the right to substitute any component of the Prize for a component of equal value at the Promoter’s sole discretion.
  7. All additional expenses incurred are not included in the Prize and are the responsibility of the Winner.
  8. The Winner will be notified by telephone and email on the dates specified in clause 7.
  9. The total Prize value is:

The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, and place of residence) and to disqualify any entrant who submits an entry that is not in accordance with these Terms and Conditions or who tampers with the entry process. Errors and omissions will be accepted at the Promoter’s discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
  11. Incomplete or indecipherable entries will be deemed invalid.
  12. If there is a dispute as to the identity of an entrant, the Promoter reserve the right, in its sole discretion, to determine the identity of the entrant.
  13. The Promoter’s decision is final and no correspondence will be entered into.
  14. The Promoter takes no responsibility for the variations in Prize values.
  15. The Prize is not transferable or exchangeable and cannot be taken as cash, unless otherwise specified.
  16. If the Prize is unclaimed, an unclaimed prize draw (“the Unclaimed Prize Draw”) may take place on the dates below by STC at Wharf 4/5, 15 Hickson Rd, Walsh Bay NSW 2000. The Unclaimed Prize Draw will be conducted in the same manner as the Draw as provided in clause 7 of these Terms and Conditions. The Winner of such Unclaimed Prize Draw) will be notified by phone and email within two (2) working days of the Unclaimed Prize Draw, and will be published STC website sydneytheatre.com.au/win within the same timeframe. 
  17. If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, including but not limited to technical difficulties, the unauthorised intervention or fraud or the discontinuation of the prize or product, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law (a) to disqualify any entrant, or (b) to modify, suspend, terminate or cancel the promotion, as appropriate.
  18. Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the States and Territories of Australia (“Non-Excludable Guarantees”). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion.
  19. Except for any liability that cannot by law be excluded, including the Non- Excludable Guarantees, the Promoter (including its respective officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury, or any loss or damage (including loss of opportunity), whether direct, indirect, special or consequential, arising in any way out of:
    1. any technical difficulties or equipment malfunction (whether or not under the Promoter’s control);
    2. any theft, unauthorised access or third party interference;
    3. any entry that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter;
    4. any variation in Prize value to that stated in these Terms and Conditions;
    5. any tax liability incurred.
  20. As a condition of accepting the Prize, the Winner must sign any legal documentation as and in the form required by the Promoter and/or prize suppliers in their absolute discretion, including but not limited to a legal release and indemnity form and any STC entry conditions.
  21. As a condition of accepting the Prize, the Winner's details (first name and last initial) will be listed on the STC website.
  22. The Promoter collects the entrant’s personal information in order to conduct the promotion and for the other purposes set out in the Promoter’s Privacy Policy. In order to conduct the promotion the Promoter may disclose such information to third parties including but not limited to agents, employees and service providers assisting with this promotion. Some of these parties may be located outside of Australia, including in the United States. Entry is conditional on providing this information. The Promoter may, if the entrant has opted in, and, unless otherwise advised, use the information provided for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the entrant in accordance with the Promoter’s privacy policies at  https://www.sydneytheatre.com.au/privacy-policy.
  23. Entrants should direct any request to access, update or correct information, or to opt out of further communications to the Promoter’s Privacy Officer using the contact information provided within the Promoter’s Policies.
  24. All entries become the property of the Promoter.
  25. These conditions constitute the entire agreement of the parties relating to the entry and the conduct of the competition.
